everyone wants to feel soory for this guy. BS he got his...you want to commit a crime be ready to face the outcome.. he did not learn anything they still found drugs in his wheel chair. if he gets out he will be a junkie on wheels. even after he had his first weck he was back at it. he had a history of getting away at any cost. now he wants to get money..... FU ....why not use some of that money and pay back all the people for the cars he took and damaged ...everyone wants to make this idiot a victim...

I would like to start by referencing the Denver Police Department Operation Manual. I am referring specifically to section 105.01 (3) a. : CASE LAW: …Law Enforcement officers are permitted to use force to effect and arrest only to the extent that it is “objectively reasonable” under the circumstances. (Graham v. Conner, 490 U.S. 386, 397, 109 S.Ct.1865, 104 L.Ed.2d 443)
In this article, the Alan explains that this particular Denver Metro Auto Theft Team (DMATT) sting was comprised of at least 18 law enforcement officers that included Arvada Detective Bill Johnson, seven Arvada Police officers, 4 troopers from the Colorado State Patrol, 1 DEA agent, two Lone tree Detectives, and Investigators from Mountain View, Denver and Colorado State Parks. All armed with shotguns, rifles, pistols, and late in the article we find out even “crescent wrenches”. Detective Johnson was reported as having done his homework. He knew that the Darrell’s right arm was paralyzed. He knew that Darrell sometimes carried a gun and was an expert driver, and was even known to flee if confronted. The informant in this case was a fellow named Pachello. Being a criminal himself, he evidently exuded creditability, telling detectives that Darrell was a flight risk and dangerous. Detective Johnson took it: hook, line and sinker. So Detective Johnson mobilizes a small army to capture the one-armed car thief. Shotguns, pistols, rifles and … garage tools.

Section 105.05 (3) A police officer may resort to the lawful use of firearms under the following conditions when all reasonable alternatives appear impracticable and when he reasonably believes that it is necessary…
Let’s just think this through just a little bit: A Detective rounds up the posse to take into custody a 100 pound maybe 110 pound, 19 year old dope addict with one working arm. The have the guns, they have the information, they have a plan. The have nearly 27,500 pounds of automotive steel at their disposal to aid in the apprehension of Darrell and his 4,300 pound car. Darrell is in the bantam weight class at just over 100 lbs. The posse, combine their brute force at nearly 3,240 pounds of sheer cop terror!! Now: the sting. It was very important to have the sting setup in a poorly lit parking lot. This way nobody would get hurt. The plan was to block Darrell in with the large vehicles, making an escape impossible. Then came the snow storms. The sting was supposed to happen during the afternoon, but in the posse’s infinite wisdom, they decided to wait for Darrell. Never mind that any of the snow that turned into slush would turn into ice. Never mind the fact that what was obviously a dangerous situation to begin with (18 law enforcement officers were needed…) became infinitely more dangerous. Motor vehicles, ice, weapons, and adrenalin are not a real good idea. This would be true if you were at your cabin in the mountains for the weekend or in the DMATT sting. The point here is that in the interest of ‘officer safety’, the sting should have been cancelled. It should have never happened that night. The fact is, Detective Johnson and his crew had the necessary time (that couple of extra hours in the parking lot) to plan out some alternatives. Non-lethal methods, stop sticks, flash bang, pepper balls, bean bags, etc…
The fact is that I do not know what really happened. There are the very obvious truths: Darrell was a dope smokin’ fiend, that like to steal cars for whatever reason. He makes his own choices about how he wants to run his life. If he is okay with the consequences, whether they are negative or positive, Darrell has the burden of bearing those crosses. Does he make poor choices? Probably. Who hasn’t?
For those of you that like to perpetuate hate. Please take a long look at the words that you write. Those words might actually encapsulate your shallow feelings, but please remember this: Darrell has both a mother and a father. They might not be the picture perfect parents that we would all like to have, but they are his parents, and they love him unconditionally. They have feelings. I had the opportunity to listen to Darrell’s mom as she read allowed some of the very hurtful comments aloud. Her voiced cracked as she read post after post that reiterated the wishful thinking that Detective Johnson would have actually succeeded in killing Darrell. The awful posts hoping that Darrell would die from an infection. If you wrote that or anything close to it, you should be ashamed of yourself. If it was in God’s plan for Darrell to die that day, then that is the way it would have happened. God obviously has something else planned for Darrell. Frankly, it’s really none of your business. If you are such upstanding and productive citizens, then take part in your civic and social responsibility and elect officials that can make you happy. There is a 99% chance that you have never met or sat and talked with Darrel Havens. All you have are generalized stereo types that you have effectively branded Darrell with. You might be right. He may be able to commit horrible crimes with his atrophied muscles and lifeless body from his broke down wheel chair, but probably not. I will let God decide. It’s not my will, but his.

I got my car stolen while I was unemployed and it devastated me and my family. Totally F'd up my life. So since I am poor, did I run out and start smoking crack and stealing cars? Was that my only choice because life dealt me a bad hand?
I am sick of Westword making excuses for these low life bastards.
Stealing cars and wrecking people's lives so he can do drugs is pretty bad. Sorry what happened to him but I don't think Westword would write a sympathetic article if he had run over the cop and paralyzed him.

And I agree with you, hopefully Baby Blue will know the reality of how a law enforcement officer's decision is made, in a split second, based on all available information and perceptions. Its easy to be an arm chair quarterback for those that watch too much True TV and reality shows involving officers. One hour of Law & Order doesn't qualify one to be an attorney or cop. And, true that her admiration of Darrell is based on his "advice" and mentoring.....but he didn't follow his own advice. He could have made the right choice, but didn't. She has made the right choice, and will hopefully follow on the path that she has chosen. @Baby Blue, I want you to see that this "corruption" you perceive as on-going in law enforcement may not be what you think it is. Sure there are a few bad eggs in every business in the world. But I'd like to see you base your perception on the actual experience of working in law enforcement - not your friends or relatives experiences - passed on like folk lore. The officers in this country do a very fine job with the resources that they have. Don't perpetuate hate and rumors. When your tour with the Marines is over, get a degree and join a law enforcement agency.....and see for yourself what the facts are. I suspect that you will be very surprised. Good luck to you!

knowing Darryl on a personal level as a friend but more like family. yes i understand he has done things to other people, but the ones who hear all the police bull shit should just keep your mouth shut. denver PD is one of the most dirty departments i have heard of or ever seen on first hand experience. I am a Marine and growing up i looked up to Darryl like an older cousin and when i did wrong he always told me not too follow his footsteps and become something. him along with many others that i knew from the "streets" pushed me to graduate and threaten if i didnt then they would not associate with me and look at me now. i graduated and have been a United States Marine for 3 years now. he has touched many people, and families in many great ways. he is a great guy and just needs some help just like a lot of us, especially District 4. i plan on becoming a police officer and joining SWAT or undercover team once i depart from the service. and it may take an inidivdual like me that has came from a messed up background and actually knows the street to make a chance in the crooked and very dirty police justice system. i am currently a military justice clerk and plan to be a member that will change the government and take dirty cops off the street. i love you big cuz, keep your head up it will get better believe me. god bless.

you know we all were kids at one time.darrell was caught up with the wrong people.The people that he hurt was his family and hes self.and if his dad was not locked up darrell would of had a different life style because my brother would of taught him right from wrong.You know its sad that growen adults are responding in such bad language and haters.and for all of you people darrell is doing alife sentence being in a wheel chair the rest of his life.and for tax payers if he would get parol the family would take on two jobs and do what it takes to care for darrell. $200K a year is a joke! Why shouldn't we have to spend our tax money on shit like that? The only reason we should keep him in prison, is if our taxes pay him state aid or social security. Can a judge sign a document not allowing "no aid" upon his release?
Our justice system and our department of corrections are also to blame. The justice system give out to weak of sentences, to first time offenders. They do there six months to a year, get out, and do the same thing again. After going in and out for years at a time, then they might do 5 to 10 years, to get out and do the same thing again!
We need our correction centers (prisons) to rehab these inmates, so they can be productive upon their release. Yes it would cost a little more, but it will be more cost effective in the end! The lifer's deserve nothing, but a bullet!
Next, the police on this sting did a horrible job, by the sound of it! 18 officer's and highway patrol? Come on! With all the technology today? Follow the suspect and use the swat team to get him while he is sleeping! Even though he had no gun, a car is also considered a powerful weapon, and could be used as deadly force. The team leader on that call should be fired!
We all make our own choices in life, but with better upbringing, a lot of this can be avoided!
Our tax money could be spent a lot more effective also...

Dave Armorman suggests that the cops just taze him or just shoot the tires out of the car. For the general public, how many videos does one have to watch on TrueTV showing a pursuit. A video of a pursuit looks cool and exciting. Until you have been on one, that is. The cops are scared that some innocent person is going to be injured or worse. I have been on several and they are not exciting and fun. As for just flattening the tires, how many videos does one have to see where spike strips are laid down and the tires go flat. But does the car stop? Why, NO!. The driver continues on flat tires. He continues even when the rubber comes off the rim. He continues driving on the rims, sparks flying everywhere. Only when the rims get to the condition where they just won't turn anymore the chase ends. But does the driver just sit there and let the police come and get him? Just because the car is disabled, there is usually nothing wrong with the suspects legs, and he gets out and runs. Harsh language does not work too well either to get someone to stop. Darrell always seemed to find a way to get away before. He always had a great time, great fun running from the law and getting away, because law enforcement thought that continuing the chase was too dangerous to other people just to make an arrest for an auto theft rap. The cops cared. Darrell didn't give a shit. He was just having a hell of a great time eluding authorities. Well, now it is time to pay the piper for all his indiscretions. Some write about it only being petty auto thefts and who cares? Well if it was your car that you were working your ass off to pay for and your irreplacable property that he stole maybe you would think differently.

Havens is the one who was paralyzed and not the person(s) he would run over displaying his 19 year old “expert driver” skills while attempting to elude justice. And, as an added bonus, perhaps he will now be a more productive member of society. Doing nothing would be an improvement.

This whole thing is wrong on so many levels. The chances that that kid was trying to kill anyone that night are less than zero. Surrounded, scared, and probably high, he was just trying to get away. But no cameras can attest to that, and you think the cops are not going to back up one of their own. I wish there were just one of those cops there that night that would tell the truth. He is imprisoned in his body for the rest of his life. That is for sure punishment enough. This story is a great illustration of the problems that guns often cause, especially when non lethal weapons are at everyone's disposal. The original plan was to taze him. Howbout blowing out his tires and doing just that? A plan gone horribly wrong and a follow up that is even worse. Shame on the police deparment. Let him out of prison!

I can't blame the police, the creep was trying to kill a cop. Had he succeeded, there would be no respect for any life, even assuming the convict had any to start.
I'm not exactly crying over the "substandard" medical care in the prison, it's a lot more than many millions of productive citizens get or can afford.

Ironically I know both his dad and the Officer that shot him. Dad has been in prison for a looong time...covered in jailhouse tattoos...cooking meth...and violence...he actually was a "Trustee" in the El Paso County Jail when I was a Deputy there.....kid didn't really have a chance...as for the Officer that shot him...he is a very calm detective...kind of a big "bear" of a guy...but very professional....the kid made the wrong choice to try to run him down...pretty stupid...

The o' so wealthy family that was so successful in keeping him out of a life of crime in the first place. He just wants to get out so he can use drugs and live off the system. In jail he is simply living off the system and having a slightly constricted life... alot nicer than he deserves. For those of you talking about how this wasn't a serious crime, just auto theft... Think they'll do a story on the pain and suffering of the cab driver's family who's death Mr. Sudduth helped cause? Don't hold your breath. This story seems determined to encourage sympathy for someone who's own decision to engage in criminal activities caused his problems. Lots of people have had misfortunes in life, they don't all turn to crime. It's always sad when someone so young becomes so permanently disabled, but let's not forget, the young man made his own decision to become a career criminal (albeit a short one) and his result is always a possibility. Perhaps instead of feeling sympathy for someone who caused his own trouble, we should feel resentment for someone who's criminal activities will continue to funnel hundreds of thousands of dollars for care that could be better spent on people more deserving.

The unfortunate thing about this story is that everything is true. This kid is a career criminal punk, and does deserve everything he get's thrown his way. However, on the flip side, yes it is unfortunate that us taxpayers are suffering the consequences of this child's actions. With that being said, I would like to see all these extremists come up with a logical solution to this issue, aside from euthanasia, which I'm sure most of the "intelligent" individuals on this forum would support. Unfortunately, there is no happy solution for anyone. release him, and allow his family to rack up charges and taxes via Medicare/medicaid and welfare, or keep him locked up to rack up the charges there. Well done, Alan! I think you developed the moral and policy nuances of this complicated story quite well. A redneck at heart, with zero tolerance for thieves petty or grand, I am inclined to side with those who regret Officer Johnson is not a better shot.
Yet, many criminals much worse than Havens suffer far less than he. I am inclined to agree with Dave Michaud (hardly known for being a limp-wristed liberal) that the very large sum spent to house and provide lousy care to Havens (who demonstrably no longer poses a serious threat to the public and has suffered as his punishment a fate many would deem worse than death) could be far better used in these difficult economic times to imprison several sociopaths who WOULD pose a serious threat if released.
Indeed, I can think of a few politicians, CEOs, and judges who have caused far more harm to the citizenry than Havens who might profitably take his place.

It's stolen cars, who cares? The more cop shows I watch on Investigation Discovery the more it shows what lying pieces of ---- most cops are! What the fat a-- cop couldn't get out of the way fast enough when the kid was trying to run? Don't most people with higher-end cars carry full coverage insurance? I had my car stolen in Denver a couple of years ago, it took the cops 4 hours to come and take a report. When my car was found a week later, it was a couple of blocks from my house, what did DPD do?, well of course they had it towed to the Denver inpound so that I would have to go down there and stand in line with 1000 illegals and deal with the rude witch behind the window in order to get it back, couldn't they have called me? I'm not saying what this kid did was right, but I get sick of the adrenalin filled idiots patting each other on the back when they finally manage to catch a criminal.

Man what a tragic story. I couldn't imagine the nightmares the officer must have. But the true tragedy of the story is how he missed putting a round into this punks head.
