Get Out!: Arizona and America Join Joe Arpaio in Rushing to Inquire: Are Your Papers in Order?

Unable to regulate our border, unwilling to create a reasonable path to citizenship for the immigrants who labor in our place, Arizona law enforcement officially now undertakes to rid us of Mexicans.

Because of infamous Arizona Senate Bill 1070, which is scheduled to take effect on Thursday, July 29, the pretext of traffic stops will now initiate a search for residency papers, a practice at once abhorrent and also under consideration by as many as 20 other states.

The national terror of reconquista will now flood the streets and courts of Arizona.

The ACLU and the United States Justice Department are seeking an injunction to put SB 1070 on hold until the seven lawsuits pending can be addressed.

While lawyers cosseted in leathered briefs discuss the depth of the anti-Mexican deluge, the boots on the ground of this immigrant monsoon wear badges and guns.

If police officers were supermen, there would still be the matter of kryptonite; lawmen, however, like the rest of us, are human: The alarm doesn't go off, but the spouse does; calls get dropped, coffee gets spilled. And, every so often, officers' problems are the stuff of television drama.

Now, like Noah with his ark, the police will sort the brown in the automobile: "You two remain; you two go to Nogales."

Daniel Magos, once an immigrant, now a United States citizen, is one man who understands the divide in a cop's life.

Once, when one of Sheriff Joe Arpaio's men had a flat tire, Daniel stopped to help.

On another occasion, a deputy was adrift in a conversation with a Spanish-speaking immigrant in south Phoenix. The officer had trouble understanding or being understood. Daniel stepped forward and translated for Arpaio's man.

Nor has Magos hesitated in the face of danger.

In 2000, he saw a group of men attacking what he believed was a mojado, a wetback. Magos summoned a deputy. The lawman grabbed one of the belligerents, and as his compadres attempted to flee in a car, they tried to run over the deputy. The officer gave his prisoner to Daniel.

"You hold him for me," Magos recalled the deputy telling him.

The deputy then gave chase in his vehicle, and the pursuit ended only when those fleeing crashed their car. In the ensuing chaos, Daniel was left to his own devices. "I called the sheriff's department and asked: 'What will I do?'"

What Daniel Magos would do today, 10 years later, is walk away.

What changed?

Only this: Daniel and his wife, Eva, were recent victims of racial profiling.

Daniel and Eva were, if you will, ahead of their time, ahead of SB 1070. And herein lies a small story about what happens when we hunt Mexicans and Mexican Americans and Central Americans in our national hysteria over the brown-skinned people among us.

We hear so often that Senate Bill 1070, which demands that police — in the course of their enforcement responsibilities — question people about their citizenship, will frighten Latinos away from speaking up in domestic-abuse calls or in drug investigations or in gang probes.

Critics of SB 1070 characterize the victims of this racial profiling bill as a population caught up in some low-rent episode of Law & Order.

The caution that SB 1070 will make witnesses silent is true, as far as it goes.

But SB 1070 has a more insidious side.

The victims of racial profiling sacrificed to the nativist fears that spawned SB 1070 are just as likely to be upstanding American citizens, even Good Samaritans like Daniel Magos .

Keep this in mind as America rushes to inquire: Are your papers in order?


Born in 1945, Daniel Magos is soft-spoken, reserved, firm. Despite the run-in with a sheriff's deputy he and his wife suffered, his manner is dignified, not put-upon. He presents the sort of serenity you see upon the faces of victims portrayed on holy cards. Not to suggest Daniel is a saint — he's simply a good man and a better neighbor.

He met Eva in 1965, as a 20-year-old, at the American Legion, Post 41, in Phoenix. "I was sitting at a table by myself when she and another lady came over and asked if they could sit down. It was her friend's idea."

When he met Eva's family, he had one vivid impression: "Her father was quite strict . . . If you went out to dinner, you had to be back by 8 p.m."

Dances offered a little more leeway on time, so Eva and Daniel would visit the Calderone Ballroom on 16th Street and Buckeye Road. "Actually we went next door, to Nano's. The music and the people were different. There was a higher social status at Nano's."

    I saw the movie "No country for old men". and it shows a very scary side of what is probably making people in the South West sound so evil and angry at illegals. (yes you do all sound evil and angry) As a Hispanic American I feel for people like Daniel Magos who will have to suffer for his fellow Mexican's abuse of American immigrations laws. Remember, the people running drugs and guns into the U.S. are criminals and break all kinds of laws including drug laws. I would venture to guess that by the size of the U.S. drug market most of you who have written comments here have broken U.S. drug laws and should be at this moment writing your comments from jail. Not just because we are a nation of laws, but because of you thousands are dying here and in Mexico. And when it comes to American jobs, no American has ever worked in the fields that produce most of our food. Not when slaves were brought in from Africa, not when immigrants from Europe and Asia worked the land and certainly not now. I don't know about my fellow "proud" hispanics who wrote before me, but I'm not crying because some illegal stole my job picking green vegetables in the Arizona desert. But, until you or your parents get stopped and abused by some racist cop and like Mr. Magos maybe you'll get the idea. Oh... it's not the law that is bad it's just that Devil is in details... and the Devil will get you sooner or later......Peace

    I live in south Texas, not far from San Antonio. I absolutely love the Mexican people and the Mexican culture. San Antonio is a Mexican city. It was founded by the Spanish and was part of Mexico long before it was part of the US. We've had people here illegally for generations, but until recently it wasn't much of a problem. It's a problem now. I'm sure those opposed to the Arizona law mean well, for the most part, but they are doing far more damage to Mexican Americans than those of us who simply want our laws enforced. You folks who scream about Arizona are creating a backlash and good Mexican people are going to be hurt as a result of your ignorance. You are stirring the pot and fomenting hatred. You are helping no one. My advice? Keep your damn mouths shut and let people who have to live with the problem our Federal government has created by failing to do it's job do it for them. We are capable, we are willing, we are able. But what you don't seem to understand is that if you increase the illegal problem in Texas by forcing people to flee Arizona, SB 1070 is going to spread across the Lone Star State as well and more people will be hurt. Do you want to help? If so, shut the hell up, por favor.

    I just recently had my window shot out from a vehicle containing mexicans. Don't give me the sob story of the century. My wife missed this bullet only by inch's. The same night a patrol car was rammed causing injuries to the officer due to the same culture. The drugs are coming in from the trains in Denver. There are different cultures involved with this however. We are totally sick of the continued lack of respect, for our laws and our people. You do not realize why its important to close the borders to the USA. There are specialists coming across from other countrys and they believe me are not so pleasant. If anyone comes legally to this country the members of all states welcome you however if you have invaded America, you have broken the law and I hope all states check your Identification, due to the extremeists that are out their, other than our corrupt corporations, that are encuring this invasion.

So you can keep crying racism all you want. Keep harrassing, keep threatening, keep waving your mexican flags: because your only showing the nation that a mob of lying thugs are the real supporters of illegal immigration, not the compassionate humanitarians you masquerade as.

Because only "brown" people are illegal, right? As the article said, unles you're willing to have your children go into crop picking or hard labor after high school, the illegals aren't taking your jobs. I just wanted to make sure I had a firm grip on the situation.

    This writer never specified how they were victims of racial profiling, or did I just miss it? If he is now a legal citizen then what is he complaining about. It sounds like he is happy here and has nothing at all to complain about. Maybe it's not Eva and Daniel with the problem. I think it might be Michael Lacey just trying to stir things up by making one feel sorry for non-legal residents. Breaking the law is breaking the law no matter what. If someone feel they have the right to steal, or murder or hurt another does that mean they can just because a certain group of people stand behind them? No! OF COURSE NOT

    Put this whole debacle to rest, REQUIRE EVERY citizen of this country to carry proof of citizenship. White, black, brown or yellow, when asked you MUST produce papers. Do not single out a race, creed or nationality. Make us all do it and arrest those who do not comply. Simple really. Times have changed in the last 200 years and for safety sake, please require EVERYONE to prove who he or she is. I'm not scared. Are you?

    There is a reasonable path to citizenship for the immigrants in this country. We could have a lot more people become US citizens. I would happy welcome them. The correct process is to leave and apply legally. But because we have what 8 - 20 million people already here illegally (a word you failed to use), we don't "need" that many the illegal ones.

    Michael Lacey - have you read SB1070? I think not. And how do you come to the opinion this is a bill all about Mexicans? The error many make in thinking this is a bill that will allow racial profiling is loud and clear in your article. I am a member of a proud hispanic family, here legally, and we love the strong hispanic heritage in our State. SB1070 is not about anti-Mexican - it is all out pro-United States, trying to restore a value to american citizenship, slowing the drain on social services, blocking the use of fake identification, curbing the drug trade that is a DAILY dangerous issue here, aiding national security because, if you've done your homework, you know that 52,000 non-mexican illegals crossed our southern border in 2009 - all middle east countries are represented in the number, and on the side of the hard working, only want to improve their lives, immigrants, they are subject to abuse and living in the shadows - no way for anyone to live! If you want to discuss this as a Mexican problem, then let's put pressure on the Mexican government to improve the living conditions and opportunities for their people! Let's reform our immigration policies to allow a worker program. But let's not confuse Arizona's attempt to help its citizens by mirroring a federal law that is not being enforced with a racial issue - that is a lazy, uninformed argument.

    Raises my voice with the others that this is not about racism, nor is it about "ridding us of Mexicans". If the author of this article had a clue, they would know that. I live in Arizona and unless you live here you cannot understand what it is like to have public US lands closed to American citizens because of drug smugglers and illegal crossers. Public American lands! Closed off because of illegals! If that doesn't outrage you how about the rancher who was killed? Or the rancher's daughter who was raped and tried to prosecute but the illegals got off free? I am Hispanic, I am a daughter of immigrants, immigrants who came here legally! What makes these people so special? NADA! Nothing! If you can afford to have the coyote bring you over illegally you can afford to wait and do it the right way! This is a FEDERAL law that we have adopted as a State law. If the fed won't enforce it, we will!! I will vote everyone who is in office right now who is against this law or refuses to enforce it.     This is a good law. If U.S. citizens go to a different country, we need to provide ID to show we are allowed there. In addition, how is this any different than carrying a driver's license and being pulled over. Gee wiz, either you're legal (and should have nothing to hide) or you are illegal and should go home.

    I am much relieved to see that others agree that this article is ridiculous. Living in Denver, I can only hope that we pass something similar and soon, otherwise, those illegals in AZ will be coming here. They do not wish to BECOME AMERICAN citizens. They don't learn the language. But then again, why should they. WE are bending over backwards to provide translators. When would another country provide a translator in traffic court? I hear that the spanish speaking violators' sessions are held first so the court only has to pay the translator for that part of the day.

    Those Mexicans who lived in the southwestern part of the country when it became a part of the U.S. and who stayed here are not immigrants. They are Americans. Anyone of any nationality who later came in legally is an immigrant. Anyone of ANY nationality who came in illegally is an illegal immigrant. The Arizona law is directed only at this last group -- and not all of them are Mexicans. Secondly, like so many others writing on this subject, you seem not to have read the bill. It specifies that people may not be questioned about their immigration status UNLESS they have already been lawfully stopped for some other violation. The law doesn't target honest citizens and it doesn't single out Mexicans. It targets only illegal immigrants. However, extremists on both sides are locked in a war of words over the bill because of their misunderstandings of what's in the bill, or because of a fear of how the law MIGHT be enforced -- and of course until it goes into effect, no one knows if it will be enforced in a racist way or not.     Very good Sue. This article is uniquely one-sided! Living in the Tucson area and witnessing what we have for so many years is not easy to stomach. My grandparents came here the legal way like soooo many others and became AMERICANS, not such-and-such-Americans. Just AMERICANS. There is a huge difference in this way and the ILLEGAL way. And hmmm, what do they not understand about the term "ILLEGAL"?

    A deal is a deal. look at the Red,White and Green Mexican flag LOGO at the beginning of this article..The editor says"much of our country used to be their country"..So what? The U.S. purchased the Southwest in 2 agreements of $15 million and $10 million, sizable sums in those days, under the 1848 Treaty of Guadalupe Y Hidalgo...so now is he implying the U.S. should give back the land to Mexico. I bought a car from someone should I give it back? We bought Alaska from Russia for a few million dollars and at that time it was called "'Sewards Folly'" the then Sec'y of State, should we return Alaska to Russia?..Get a life, a 'deal is a deal'! P.S. On immigration, the law is the law and this is a country of laws or at least it used to be B.O. (before obama)

    All well and good, but read the recent headlines in Colorado (or Pennsylvania, or Texas, or Illinois) or pretty much any other state in this country. Who is it shooting people? Who is it stealing vehicles and killing people in hit-and-runs? Who is it executing fraudulent financial activity with stolen social security numbers, credit card numbers or other personal data? While there are many people doing so, the vast majority are directly identified as illegal aliens. I have NO ISSUE with legal migration to the US - my Irish, Scottish, German and Dutch ancestors all emigrated to the US/North America over the past 268 years. The difference? They did so under the laws of the land of the day; they learned, respected and practiced the customs of the land they adopted, and that adopted them; they learned and used the common language of the land to conduct their business, gain their education and contribute to society; they worked backbreaking jobs of unreasonable hours for pitiful pay instead of utilizing what few social services existed at the time. I applaud the effort of any LEGAL immigrant to the United States, or any other country, to become a part of our great nation and our national fabric...what I cannot applaud and will never support is the person that will knowingly and willingly contravene even the most basic laws of this land for their own personal selfish gain...and that is EXACTLY what illegal immigrants to this country are doing on a daily, indeed an hourly, basis.

We met a few times in Phoenix... a laundromat on 40th St., a parenting class your wife would rather forget, the bar at the Embassy Suites while you were single... and I know some of your vintage writers..and remember how you built the New Times into a real newspaper and brought in Tom Fitz... And your writing about this only reinforces my belief that you are one of the great newspapermen and news writers in the USA... And you know how to pin the tails on all the braying jackasses in Arizona... Thanks for this... I knew a lot of people like Daniel Magos growing up in south Phoenix when a lot of it was still cotton fields... I knew them on the ranches my father bought cattle from.. I know them today from my Mexican wife's family... Thanks for writing this... keep it up... Run Arpaio and all his bullyboy racists out of Arizona...

    Fool that wrote this, one side of the story, come here and live, come see what is happening here.. fool, you should open your eyes to the whole picuture not just a piece of it. You and your thoughts are killing this country, no other country, including Mexico, would allow the abuse that is happening on the borders. Sleep tight with your shallow thoughts.
