Accused Aurora theater shooter James Holmes was in court today for a brief hearing. Among the most interesting tidbits of news was that prosecutors have 4,000 potential witnesses lined up for Holmes's February trial. To prepare their cross-examination, defense attorneys have asked prosecutors for a "good faith" list of which witnesses they intend to call.
Holmes will be back in court starting October 7 for more in-depth hearings, during which the sides will debate what evidence should be allowed at trial.
Back in June, Holmes's defense attorneys filed nearly ninety motions dealing with jury selection and the evidence that jurors will be allowed to hear at Holmes's February trial. They're requesting that several pieces of evidence -- including photos stored on Holmes's iPhone, items found in his car, and e-mails and chats associated with his Match.com and Adult Friend Finder accounts -- be suppressed.
At a January preliminary hearing in the case, police officers testified that Holmes took photos of himself posing with weapons in the hours before the shooting. Various weapons were also found in his car when he was arrested at the scene, they said. As for his dating profiles, police testified that they featured the headline, "Will you visit me in prison?"
Holmes's defense attorneys are also seeking to suppress statements Holmes allegedly made to the police officers who questioned him. Holmes told them that his apartment was rigged with explosives, among other statements, the officers testified in January.
Starting October 7 and continuing for at least two weeks, lawyers will debate seventeen of the defense's motions, according to a schedule agreed upon by both sides. The motions include those referenced above, as well as efforts to suppress evidence seized from Holmes's computers, bank records and e-mail accounts.
