Celia Montoya charged with holding down ten year old while boyfriend sexually assaulted her

If the accusations pressed by the Denver District Attorney's Office are accurate, Celia Montoya is guilty not only of serious crimes, but a betrayal of trust that's positively off the charts.

Montoya allegedly held down a ten-year-old family member while her much older boyfriend, Eugene Fernandez, sexually assaulted her.

Because of the victim's age and the description of family relationships, the document is heavily redacted. But enough of the narrative remains to understand the extraordinarily rude awakening the girl says she received.

On the night in question, between April and May of 2012, the girl said she was staying in another relative's home and had planned to sleep in the living room. However, she was frightened and climbed into an already occupied bed -- presumably by Montoya and Fernandez.

The girl fell asleep in the middle of the bed -- but she was jolted to consciousness by the feeling of someone touching her "private part;" she also discovered that her underwear had been lowered. She began crying and tried closing her legs, but she couldn't do so -- and neither could she escape, because Montoya "was hugging her and wouldn't let her leave." The assault only stopped when her alleged assaulter, Fernandez, go up to use the bathroom, leaving the girl to sob herself to sleep.

In the immediate aftermath of the attack, the girl didn't report the assault. Then, this year, she had the uncomfortable experience of having to celebrate her birthday with Montoya present. At that time, the girl said Montoya apologized to her for what happened, saying, "I know you didn't like it and that you were uncomfortable around him after that."

This I'm-sorry certainly didn't make everything better for the girl, who told her story to investigators earlier this month. Now, Fernandez has been charged with aggravated sexual assault on a child, while Montoya is accused of sexual assault on a child and child abuse. They currently remain in custody on large bonds -- $100,000 for Fernandez, $200,000 for Montoya -- and are expected in court for a preliminary hearing next month.
