Updated: The City of Denver recently argued that an order banning protests outside the courthouse where Dexter Lewis’s death penalty trial was underway should be upheld because there might be civil unrest if Lewis was sentenced to die when Aurora theater shooter James Holmes wasn’t.
As court documents note, Lewis is black, while Holmes is white.
This point is now moot: A short time ago, the jury in Lewis’s case opted for life in prison without the possibility of parole rather than death.
The decision is likely to upset the writer of the following comment, shared on our post about a judge’s rejection of the aforementioned court order.

Every murderer should get the death penalty no matter the color of their skin. I don’t care what color you are or if you killed 1 or 20, it should all be the same fate. Holmes should have gotten the death penalty…..let’s stop trying to make everything about race. Stupid media always making it about race smh.
