At 5:25 PM on October 17, 2009 the Denver Office of the Medical Examiner was notified by Denver Health Medical Center of the death of Matthew Dailey (a 3 month/White/Male) of Denver Colorado. An autopsy was completed on the baby and the cause of death is Complications of Blunt Force Injury to Head. The manner of death is Homicide.The baby was transported from 212 Lincoln, Denver, Colorado on September 15, 2009.

Last week, we told you about Stephen Dailey, who was charged with attempted first-degree murder for allegedly shaking his two-month-old son well past the point of no return. But that's changed. The child died a couple of days later, and shortly thereafter, Denver District Attorney Mitch Morrissey amended the most serious charge against Dailey to first-degree murder. If the facts support this accusation, the judge should throw the book at this guy. In fact, if your honor would like to borrow some extra books to throw, I've got some I can loan you.

MAN ACCUSED OF SHAKING BABY NOW CHARGED WITH MURDERDenver District Attorney Mitch Morrissey has amended the charges filed against a man accused of shaking his 2-month-old son in September.
Stephen Dailey (dob: 04-21-89) is now charged with first-degree murder (F1) and child abuse resulting in death (F2).
On September 15, 2009, emergency services responded to the 200 block of Lincoln Street on a report of a 2-month old baby not breathing. Dailey was originally charged with attempted murder and child abuse resulting in serious bodily injury. The baby died at a local hospital on October 17, 2009 and the charges were formally amended on Monday, October 19, 2009. The charges allege that Dailey shook his 2-month-old son, causing fatal injuries.
Dailey is scheduled to appear in Denver County Court, room 12T, on Tuesday, October 27, 2009 at 9 a.m. to be advised of the amended charges.
